At Entertainment Solutions, we strongly care about the security of all the data we manage, therefore, we make our data protection policy available to all users.<br><br>In this case, it is very important to distinguish the different roles that we play in the information management processes since we can act as <strong>responsible</strong> for treatment or act <strong>in charge of</strong> the treatment.<br><br>How can we differentiate between these roles and how does it affect me as a user of the information?<br><br>We are going to explain it, following all the legal measures that the European Regulation of data protection and the Organic Law of Data Protection and Guarantee of Digital Rights mark us.<br><br><br><div class="p-3 font-bold text-xl border border-2">Entertainment Solutions will act as responsible for treatment in cases that it processes data of the property that hires the application services.</div><br>For which it is reported that:<br><br>Entertainment Solutions S.L. is the Responsible for the processing of the personal data of the Interested Party and informs that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018 , of December 5 (LOPDGDD), for which the following treatment information is provided:<br><br><strong>Purposes and legitimacy of the treatment:</strong>maintain a commercial relationship (for the legitimate interest of the person in charge, art. 6.1.f GDPR)<br><br><strong>Data conservation criteria:</strong> they will be kept for no longer than necessary to maintain the end of the treatment or while there are legal prescriptions that dictate their custody and when it is no longer necessary for this, they will be deleted with adequate security measures to guarantee anonymization of the data or the total destruction of them.<br><br><strong>Communication of the data:</strong> the data will not be communicated to third parties, except legal obligation.<br><br><strong>Rights that assist the Interested Party:</strong><br><br><ul><li class="list-disc ml-4">Right to withdraw consent at any time.</li><li class="list-disc ml-4">Right of access, rectification, portability and deletion of your data and of limitation or opposition to its treatment.</li><li class="list-disc ml-4">Right to file a claim with the Control Authority (www.aepd.es) if you consider that the treatment does not comply with current regulations.</li><br><strong>Contact information to exercise your rights:</strong> Entertainment Solutions S.L. Castellón Km 5,25,, - 50720 Zaragoza (Zaragoza).<br><br>What does “in charge” mean?<br><br><div class="p-3 font-bold text-xl border border-2">Entertainment Solutions will act in charge of treatment in cases that it processes data that is incorporated to the application, on behalf of the property.</div><br>The Spanish Agency for Data Protection defines the person <strong>in charge</strong> of the <strong>treatment</strong> as the natural or legal person, public authority, service or other body that provides a service to the responsible that involves the processing of personal data on his behalf.<br><br>In this case, Entertainment Solutions, will not treat or manage the data of property employees, guests, staff on their behalf, but it will be the property itself that will have the management and control of all this data.<br><br>Entertainment Solutions will only have access to them at the level of storage, updating, technical support or similar and always at the property's expense, never on its own initiative.<br><br>For this reason, the end user application will incorporate the privacy policy of each property.<br><br>The LOPDGDD is very clear in this regard and therefore we inform that:<br><ul><li class="list-decimal ml-4">That both parties will process the personal data object of this contract, in accordance with the provisions of Regulation (EU) 2016/679, of April 27, 2016 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD).</li><li class="list-decimal ml-4">That the <strong>responsible</strong> has contracted the services of the <strong>in charge</strong> consisting of:<ul><li class="list-disc ml-4">Services provided: cloud platform where end users (property customers) can access various services offered by a property or property chain.</li><li class="list-disc ml-4">Duration of the contract: linked to the time established in said service contract.</li></ul><li class="list-decimal ml-4"> That for the fulfillment of said services, the <strong>in charge</strong> finds it necessary to access and process the personal data that is the responsibility of the <strong>responsible</strong>.</li><li class="list-decimal ml-4">That, in compliance with the provisions of article 28 of the GDPR, the <strong>in charge</strong> offers sufficient guarantees to implement appropriate technical and organizational policies to apply the security measures established by current regulations and protect the rights of the interested parties, for which reason Both parties agree to sign this contract subject to the following</li></ul><br><div class="text-center font-bold">INSTRUCTIONS FOR DATA PROCESSING</div><br><ul><li class="list-decimal ml-4 font-bold text-xl">Object, nature and purpose of the order<ul class="text-base font-normal"><li class="list-disc ml-4 pt-4">Purpose of the order: offering the digital platform for the property to manage both its service offer and the information of the end users (guests).</li><li class="list-disc ml-4">Duty to inform the interested party of the treatment: it will correspond exclusively to the <strong>responsible</strong>.</li><li class="list-disc ml-4">Location of the treatment: in the premises of the <strong>in charge</strong> and the <strong>responsible</strong>, with the authorization of the <strong>responsible</strong> to incorporate the data into their systems.</li></ul><br></li><li class="list-decimal ml-4 font-bold text-xl">Type of personal data and category of interested parties<ul class="text-base font-normal pt-4"><li class="list-disc ml-4">Type of personal data to which the <strong>in charge</strong> will have access: Basic data (Name, surname, email address, ID…) and data on the use of the platform (contracted property services, stays, activity reservations… ..)</li><li class="list-disc ml-4">Categories of stakeholders: Property guests, Property staff</li><li class="list-disc ml-4">Authorized treatment operations: those strictly necessary to achieve the purpose of the order.</li></ul></li><br><li class="list-decimal ml-4 font-bold text-xl">Obligations and rights of the <strong>responsible</strong><div class="text-base font-normal pt-4">The <strong>responsible</strong> guarantees that the data provided to the <strong>in charge</strong> have been obtained lawfully and that they are adequate, pertinent and limited to the purposes of the treatment.<br><br>The <strong>responsible</strong> will make available to the <strong>in charge</strong> all the information necessary to carry out the services that are the object of the order.<br><br>The <strong>responsible</strong> advises the <strong>in charge</strong> that, if he determines on his own the purposes and means of the treatment, he will be considered responsible for the treatment and will be subject to comply with the provisions of current regulations applicable as such.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Obligations and rights of the IN CHARGE<div class="text-base font-normal pt-4">The <strong>in charge</strong> undertakes to respect all the obligations that may correspond to him as the person in charge of the treatment in accordance with the provisions of current regulations and any other provision or regulation that is equally applicable.<br><br>The <strong>in charge</strong> will not allocate, apply or use the data to which he has access for a purpose other than the order or that involves the breach of this contract.<br><br>The <strong>in charge</strong> will make available to the <strong>responsible</strong> the information necessary to demonstrate compliance with the contract, allowing the necessary inspections and audits to evaluate the treatment.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Personnel authorized to carry out the treatment<div class="text-base font-normal pt-4">The <strong>in charge</strong> guarantees that the personnel authorized to carry out the treatment have expressly and in writing committed to respect the confidentiality of the data or that they are subject to a legal obligation of confidentiality of a statutory nature.<br><br>The <strong>in charge</strong> will take measures to guarantee that any person acting under his authority and has access to personal data can only process them following the instructions of the <strong>responsible</strong> or is obliged to do so under current legislation.<br><br>The <strong>in charge</strong> guarantees that the personnel authorized to carry out the treatment have received the necessary training to ensure that the protection of personal data will not be jeopardized.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Security measures<div class="text-base font-normal pt-4">The <strong>in charge</strong> declares to be up-to-date with regard to the obligations derived from the data protection regulations, especially with regard to the implementation of security measures for the different categories of data and treatment established in article 32 of the GDPR.<br><br>The <strong>in charge</strong> guarantees that said security measures will be properly implemented and will help the <strong>responsible</strong> to comply with the obligations established in articles 32 to 36 of the GDPR, taking into account the nature of the treatment and the information available to the <strong>in charge</strong>.<br><br>The <strong>responsible</strong> will carry out an analysis of the possible risks derived from the treatment to determine the appropriate security measures to guarantee the security of the processed information and the rights of the interested parties and, if it determines that there are risks, will send the <strong>in charge</strong> a report with the evaluation of impact so that it proceeds to the implementation of adequate measures to avoid or mitigate them.<br><br>The <strong>in charge</strong>, for his part, must analyze the possible risks and other circumstances that may affect the security that are attributable to him, and must inform, if any, the <strong>responsible</strong> to assess their impact.<br><br>In any case, the <strong>responsible</strong> guarantees that, taking into account the state of the art, the application costs and the nature, scope, context and purposes of the treatment, it will implement appropriate technical and organizational measures to guarantee an adequate level of security. to the risk involved in the treatment, which if applicable includes, among others:<br><ul><li class="list-disc ml-4">Accesses are secure (https)</li><li class="list-disc ml-4">Guarantee the confidentiality, integrity, availability and permanent resilience of the treatment systems and services.</li><li class="list-disc ml-4">Restore availability and access to data quickly in the event of a physical or technical incident.</li><li class="list-disc ml-4">Procedures for the regular verification, evaluation and assessment of the effectiveness of technical and organizational measures to guarantee the security of the treatment.</li></div></li><br><li class="list-decimal ml-4 font-bold text-xl">Breach of security<div class="text-base font-normal pt-4">The security violations of which the <strong>in charge</strong> is aware must be notified, without undue delay and within a maximum of 48 hours, to the <strong>responsible</strong> for their knowledge and application of measures to remedy and mitigate the effects caused. Notification will not be necessary when it is unlikely that it involves a risk to the rights and freedoms of natural persons.<br><br>The notification of a security breach must contain, at a minimum, the following information:<br><ul><li class="list-disc ml-4">Description of the nature of the violation.</li><li class="list-disc ml-4">Categories and the approximate number of affected stakeholders.</li><li class="list-disc ml-4">Categories and the approximate number of data records affected.</li><li class="list-disc ml-4">Possible consequences.</li><li class="list-disc ml-4">Measures adopted or proposed to remedy or mitigate the effects.</li><li class="list-disc ml-4">Contact details where more information can be obtained (DPO, security officer, etc.).</li></div></li><br><li class="list-decimal ml-4 font-bold text-xl">Communication of data to third parties<div class="text-base font-normal pt-4">The <strong>in charge</strong> may not communicate the data to third party recipients, unless they have obtained prior written authorization from the <strong>responsible</strong>; which, if any, will be attached to this contract.<br><br>The transmission of data to public authorities in the exercise of their public functions are not considered data communications, so the authorization of the <strong>responsible</strong> will not be required if said transmissions are necessary to achieve the purpose of the assignment.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">International data transfers<div class="text-base font-normal pt-4">The <strong>responsible</strong> may not make data transfers to third countries or international organizations not established in the EU, unless they have obtained prior written authorization from the <strong>responsible</strong>; which, if any, will be attached to this contract.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Outsourcing of data processing<div class="text-base font-normal pt-4">The <strong>in charge</strong> may not subcontract to a third party the performance of any data processing entrusted to him by the <strong>responsible</strong>, unless this is authorized in advance and in writing, and it is recorded by attaching the authorization to this contract.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Rights of the interested parties<div class="text-base font-normal pt-4">The <strong>in charge</strong> will create, whenever possible and taking into account the nature of the treatment, the technical and organizational conditions necessary to assist the <strong>responsible</strong> in his obligation to respond to the requests for the rights of the interested party.<br><br>Corresponds to the Responsible for Treatment.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Responsibility<div class="text-base font-normal pt-4">In accordance with article 82 of the GDPR, the <strong>responsible</strong> will be liable for the damages and losses caused in any treatment operation in which he participates and does not comply with the provisions of the GDPR, and the <strong>responsible</strong> will only be liable for the damages and losses caused by the treatment when there is no complied with the obligations of the GDPR specifically directed to the <strong>responsible</strong> or has acted outside or against the legal instructions of the <strong>responsible</strong>. In the same way, the <strong>in charge</strong> will be exempt from liability if he shows that he is not in any way responsible for the fact that caused the damages.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">End of service provision<div class="text-base font-normal pt-4">Once the provision of services object of this contract ends, if the <strong>in charge</strong> has stored personal data, or any other document and / or support that has been provided by any means, he must return or delete them at the option of the <strong>responsible</strong>, including existing copies . The <strong>in charge</strong> must issue a certificate of return or destruction if required by the <strong>responsible</strong>.<br><br>The deletion of data will not proceed when its conservation is required by a legal obligation, in which case the <strong>in charge</strong> will proceed to the custody of the same, blocking the data and limiting its treatment as long as responsibilities may arise from its relationship with the <strong>responsible</strong>.<br><br>The <strong>in charge</strong> will maintain the duty of secrecy and confidentiality of the data even after the end of the relationship that is the object of this contract.<br><br>Entertainment Solutions reserves the right to modify any type of information that may appear on the website, as well as in these conditions, without any obligation to pre-notify or inform users of said obligations, understanding as sufficient the publication in the Entertainment Solutions website.</div></li></ul><br><br><br><br>Last update: January 11, 2021
