Castellón Km 5,25,, - 50720 Zaragoza (Zaragoza).<br><br>What does “in charge” mean?<br><br><div class="p-3 font-bold text-xl border border-2">Entertainment Solutions will act in charge of treatment in cases that it processes data that is incorporated to the application, on behalf of the property.</div><br>The Spanish Agency for Data Protection defines the person <strong>in charge</strong> of the <strong>treatment</strong> as the natural or legal person, public authority, service or other body that provides a service to the responsible that involves the processing of personal data on his behalf.<br><br>In this case, Entertainment Solutions, will not treat or manage the data of property employees, guests, staff on their behalf, but it will be the property itself that will have the management and control of all this data.<br><br>Entertainment Solutions will only have access to them at the level of storage, updating, technical support or similar and always at the property's expense, never on its own initiative.<br><br>For this reason, the end user application will incorporate the privacy policy of each property.<br><br>The LOPDGDD is very clear in this regard and therefore we inform that:<br><ul><li class="list-decimal ml-4">That both parties will process the personal data object of this contract, in accordance with the provisions of Regulation (EU) 2016/679, of April 27, 2016 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD).</li><li class="list-decimal ml-4">That the <strong>responsible</strong> has contracted the services of the <strong>in charge</strong> consisting of:<ul><li class="list-disc ml-4">Services provided: cloud platform where end users (property customers) can access various services offered by a property or property chain.</li><li class="list-disc ml-4">Duration of the contract: linked to the time established in said service contract.</li></ul><li class="list-decimal ml-4"> That for the fulfillment of said ml-4">Location of the treatment: in the premises of the <strong>in charge</strong> and the <strong>responsible</strong>, with the authorization of the <strong>responsible</strong> to incorporate the data into their systems.</li></ul><br></li><li class="list-decimal ml-4 font-bold text-xl">Type of personal data and category of interested parties<ul class="text-base font-normal pt-4"><li class="list-disc ml-4">Type of personal data to which the <strong>in charge</strong> will have access: Basic data (Name, surname, email address, ID…) and data on the use of the platform (contracted property services, stays, activity reservations… ..)</li><li class="list-disc ml-4">Categories of stakeholders: Property guests, Property staff</li><li class="list-disc ml-4">Authorized treatment operations: those strictly necessary to achieve the purpose of the order.</li></ul></li><br><li class="list-decimal ml-4 font-bold text-xl">Obligations and rights of the <strong>responsible</strong><div class="text-base font-normal pt-4">The <strong>responsible</strong> guarantees that the data provided to the <strong>in charge</strong> have been obtained lawfully and that they are adequate, pertinent and limited to the purposes of the treatment.<br><br>The <strong>responsible</strong> will make available to the <strong>in charge</strong> all the information necessary to carry out the services that are the object of the order.<br><br>The <strong>responsible</strong> advises the <strong>in charge</strong> that, if he determines on his own the purposes and means of the treatment, he will be considered responsible for the treatment and will be subject to comply with the provisions of current regulations applicable as such.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Obligations and rights of the IN CHARGE<div class="text-base font-normal pt-4">The <strong>in charge</strong> undertakes to respect all the obligations that may correspond to him as the person in charge of the treatment in accordance with the provisions of current regulations and any other provision or regulation that is equally applicable.<br><br>The <strong>in charge</strong> will not allocate, apply or use the data to which he has access for a purpose other than the order or that involves the breach of this contract.<br><br>The <strong>in charge</strong> will make available to the <strong>responsible</strong> the information necessary to demonstrate compliance with the contract, allowing the necessary inspections and audits to evaluate the treatment.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Personnel authorized to carry out the treatment<div class="text-base font-normal pt-4">The <strong>in charge</strong> guarantees that the personnel authorized to carry out the treatment have expressly and in writing committed to respect the confidentiality of the data or that they are subject to a legal obligation of confidentiality of a statutory nature.<br><br>The <strong>in charge</strong> will take measures to guarantee that any person acting under his authority and has access to personal data can only process them following the instructions of the <strong>responsible</strong> or is obliged to do so under current legislation.<br><br>The <strong>in charge</strong> guarantees that the personnel authorized to carry out the treatment have received the necessary training to ensure that the protection of personal data will not be jeopardized.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Security measures<div class="text-base font-normal pt-4">The <strong>in charge</strong> declares to be up-to-date with regard to the obligations derived from the data protection regulations, especially with regard to the implementation of security measures for the different categories of data and treatment established in article 32 of the GDPR.<br><br>The <strong>in charge</strong> guarantees that said security measures will be properly implemented and will help the <strong>responsible</strong> to comply with the obligations established in articles 32 to 36 of the GDPR, taking into account the nature of the treatment and the information available to the <strong>in charge</strong>.<br><br>The <strong>responsible</strong> will carry out an analysis of the possible risks derived from the treatment to determine the appropriate security measures to guarantee the security of the processed information and the rights of the interested parties and, if it determines that there are risks, will send the <strong>in charge</strong> a report with the evaluation of impact so that it proceeds to the implementation of adequate measures to avoid or mitigate them.<br><br>The <strong>in charge</strong>, for his part, must analyze the possible risks and other circumstances that may affect the security that are attributable to him, and must inform, if any, the <strong>responsible</strong> to assess their impact.<br><br>In any case, the <strong>responsible</strong> guarantees that, taking into account the state of the art, the application costs and the nature, scope, context and purposes of the treatment, it will implement appropriate technical and organizational measures to guarantee an adequate level of security. to the risk involved in the treatment, which if applicable includes, among others:<br><ul><li class="list-disc ml-4">Accesses are secure (https)</li><li class="list-disc ml-4">Guarantee the confidentiality, integrity, availability and permanent resilience of the treatment systems and services.</li><li class="list-disc ml-4">Restore availability and access to data quickly in the event of a physical or technical incident.</li><li class="list-disc ml-4">Procedures for the regular verification, evaluation and assessment of the effectiveness of technical and organizational measures to guarantee the security of the treatment.</li></div></li><br><li class="list-decimal ml-4 font-bold text-xl">Breach of security<div class="text-base font-normal pt-4">The security violations of which the <strong>in charge</strong> is aware must be notified, without undue delay and within a maximum of 48 hours, to the <strong>responsible</strong> for their knowledge and application of measures to remedy and mitigate the effects caused. Notification will not be necessary when it is unlikely that it involves a risk to the rights and freedoms of natural persons.<br><br>The notification of a security breach must contain, at a minimum, the following information:<br><ul><li class="list-disc ml-4">Description of the nature of the violation.</li><li class="list-disc ml-4">Categories and the approximate number of affected stakeholders.</li><li class="list-disc ml-4">Categories and the approximate number of data records affected.</li><li class="list-disc ml-4">Possible consequences.</li><li class="list-disc ml-4">Measures adopted or proposed to remedy or mitigate the effects.</li><li class="list-disc ml-4">Contact details where more information can be obtained (DPO, security officer, etc.).</li></div></li><br><li class="list-decimal ml-4 font-bold text-xl">Communication of data to third parties<div class="text-base font-normal pt-4">The <strong>in charge</strong> may not communicate the data to third party recipients, unless they have obtained prior written authorization from the <strong>responsible</strong>; which, if any, will be attached to this contract.<br><br>The transmission of data to public authorities in the exercise of their public functions are not considered data communications, so the authorization of the <strong>responsible</strong> will not be required if said transmissions are necessary to achieve the purpose of the assignment.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">International data transfers<div class="text-base font-normal pt-4">The <strong>responsible</strong> may not make data transfers to third countries or international organizations not established in the EU, unless they have obtained prior written authorization from the <strong>responsible</strong>; which, if any, will be attached to this contract.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Outsourcing of data processing<div class="text-base font-normal pt-4">The <strong>in charge</strong> may not subcontract to a third party the performance of any data processing entrusted to him by the <strong>responsible</strong>, unless this is authorized in advance and in writing, and it is recorded by attaching the authorization to this contract.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Rights of the interested parties<div class="text-base font-normal pt-4">The <strong>in charge</strong> will create, whenever possible and taking into account the nature of the treatment, the technical and organizational conditions necessary to assist the <strong>responsible</strong> in his obligation to respond to the requests for the rights of the interested party.<br><br>Corresponds to the Responsible for Treatment.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Responsibility<div class="text-base font-normal pt-4">In accordance with article 82 of the GDPR, the <strong>responsible</strong> will be liable for the damages and losses caused in any treatment operation in which he participates and does not comply with the provisions of the GDPR, and the <strong>responsible</strong> will only be liable for the damages and losses caused by the treatment when there is no complied with the obligations of the GDPR specifically directed to the <strong>responsible</strong> or has acted outside or against the legal instructions of the <strong>responsible</strong>. In the same way, the <strong>in charge</strong> will be exempt from liability if he shows that he is not in any way responsible for the fact that caused the damages.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">End of service provision<div class="text-base font-normal pt-4">Once the provision of services object of this contract ends, if the <strong>in charge</strong> has stored personal data, or any other document and / or support that has been provided by any means, he must return or delete them at the option of the <strong>responsible</strong>, including existing copies . The <strong>in charge</strong> must issue a certificate of return or destruction if required by the <strong>responsible</strong>.<br><br>The deletion of data will not proceed when its conservation is required by a legal obligation, in which case the <strong>in charge</strong> will proceed to the custody of the same, blocking the data and limiting its treatment as long as responsibilities may arise from its relationship with the <strong>responsible</strong>.<br><br>The <strong>in charge</strong> will maintain the duty of secrecy and confidentiality of the data even after the end of the relationship that is the object of this contract.<br><br>Entertainment Solutions reserves the right to modify any type of information that may appear on the website, as well as in these conditions, without any obligation to pre-notify or inform users of said obligations, understanding as sufficient the publication in the Entertainment Solutions website.</div></li></ul><br><br><br><br>Last update: January 11, 2021
Desde Entertainment Solutions nos preocupamos encarecidamente de la seguridad de todos los datos que manejamos, por ello, ponemos a disposición de todos los usuarios nuestra política de protección de datos.<br><br>En este caso, es muy importante diferenciar los diferentes papeles que desarrollamos en los procesos de gestión de la información ya que podemos actuar como <strong>responsables</strong> de tratamiento o como <strong>encargados</strong> de tratamiento.<br><br>¿Cómo podemos diferenciar estos roles y en qué me afecta como usuario de la información?<br><br>Vamos a explicarlo, siguiendo todas las medidas legales que nos marcan El Reglamento Europeo de protección de datos y la Ley orgánica de Protección de Datos y Garantía de Derechos Digitales.<br><br><br><div class="p-3 font-bold text-xl border border-2">Entertainment Solutions actuará como responsable de tratamiento en los casos que trate datos de la propiedad que contrata los servicios de la aplicación.</div><br>Para lo cual se informa de que:<br><br>Entertainment Solutions S.L. es el Responsable del tratamiento de los datos personales del Interesado y le informa de que estos datos se tratarán de conformidad con lo dispuesto en el Reglamento (UE) 2016/679, de 27 de abril (GDPR), y la Ley Orgánica 3/2018, de 5 de diciembre (LOPDGDD), por lo que se le facilita la siguiente información del tratamiento:<br><br><strong>Fines y legitimación del tratamiento:</strong> mantener una relación comercial (por interés legítimo del responsable, art. 6.1.f GDPR)<br><br><strong>Criterios de conservación de los datos:</strong> se conservarán durante no más tiempo del necesario para mantener el fin del tratamiento o mientras existan prescripciones legales que dictaminen su custodia y cuando ya no sea necesario para ello, se suprimirán con medidas de seguridad adecuadas para garantizar la anonimización de los datos o la destrucción total de los mismos.<br><br><strong>Comunicación de los datos:</strong> no se comunicarán los datos a terceros, salvo obligación legal.<br><br><strong>Derechos que asisten al Interesado:</strong><br><br><ul><li class="list-disc ml-4">Derecho a retirar el consentimiento en cualquier momento.</li><li class="list-disc ml-4">Derecho de acceso, rectificación, portabilidad y supresión de sus datos y de limitación u oposición a su tratamiento.</li><li class="list-disc ml-4">Derecho a presentar una reclamación ante la Autoridad de control (www.aepd.es) si considera que el tratamiento no se ajusta a la normativa vigente.</li><br><strong>Datos de contacto para ejercer sus derechos:</strong> Entertainment Solutions S.L. Castellón Km 5,25,, - 50720 Zaragoza (Zaragoza).<br><br>¿Qué es un encargado de tratamiento?<br><br><div class="p-3 font-bold text-xl border border-2">Entertainment Solutions actuará como encargado de tratamiento en los casos que trate datos que se incorporen a la aplicación, por cuenta de la propiedad.</div><br>La Agencia Española de Protección de Datos define al <strong>encargado</strong> del <strong>tratamiento</strong> como la persona física o jurídica, autoridad pública, servicio u otro organismo que presta un servicio al responsable que conlleva el <strong>tratamiento</strong> de datos personales por cuenta de éste.<br><br>En este caso, Entertainment Solutions, no tratará o gestionará los datos de empleados de la propiedad, huéspedes, personal en su nombre, sino que será la propia propiedad quien tendrá la gestión y control de todos estos datos.<br><br>Entertainment Solutions, solo tendrá acceso a los mismos a nivel de almacenamiento, actualización, soporte técnico y similares y siempre por cuenta de la propiedad, nunca por iniciativa propia.<br><br>Por ello la aplicación de usuario final incorporará la política de privacidad propia de cada propiedad.<br><br>La LOPDGDD, es muy clara a este respecto y por ello informamos de que:<br><ul><li class="list-decimal ml-4">Que ambas partes tratarán los datos personales objeto de este contrato, conforme a lo dispuesto en el Reglamento (UE) 2016/679, de 27 de abril de 2016 (GDPR), y la Ley Orgánica 3/2018, de 5 de diciembre (LOPDGDD).</li><li class="list-decimal ml-4">Que el <strong>responsable</strong> ha contratado los servicios del <strong>encargado</strong> consistentes en:<ul><li class="list-disc ml-4">Servicios prestados: plataforma en la nube donde los usuarios finales (clientes de la propiedad) pueden acceder a diversos servicios ofrecidos por una propiedad o cadena de propiedades.</li><li class="list-disc ml-4">Duración del contrato: vinculada al tiempo establecido en dicho contrato de servicios.</li></ul><li class="list-decimal ml-4"> Que para el cumplimiento de dichos servicios, al <strong>encargado</strong> le resulta necesario el acceso y tratamiento de los datos personales responsabilidad del <strong>responsable</strong>.</li><li class="list-decimal ml-4">Que, en cumplimiento de lo dispuesto en el artículo 28 del GDPR, el <strong>encargado</strong> ofrece suficientes garantías para implementar políticas técnicas y organizativas apropiadas para aplicar las medidas de seguridad que establece la normativa vigente y proteger los derechos de los interesados, por lo cual ambas partes convienen suscribir el presente contrato con sujeción a los siguientes</li></ul><br><div class="text-center font-bold">INSTRUCCIONES PARA EL TRATAMIENTO DE DATOS</div><br><ul><li class="list-decimal ml-4 font-bold text-xl">Objeto, naturaleza y finalidad del encargo<ul class="text-base font-normal"><li class="list-disc ml-4 pt-4">Finalidad del encargo: ofrecimiento de la plataforma digital para que la propiedad gestione tanto su oferta de servicios como la información de los usuarios finales (huéspedes).</li><li class="list-disc ml-4">Deber de informar el tratamiento al interesado: corresponderá exclusivamente al <strong>responsable</strong>.</li><li class="list-disc ml-4">Ubicación del tratamiento: en los locales del <strong>encargado</strong> y del <strong>responsable</strong>, con autorización del <strong>responsable</strong> para incorporar los datos a sus sistemas.</li></ul><br></li><li class="list-decimal ml-4 font-bold text-xl">Tipo de datos personales y categoría de interesados<ul class="text-base font-normal pt-4"><li class="list-disc ml-4">Tipo de datos personales a los que tendrá acceso el <strong>encargado</strong>: Datos básicos (Nombre, apellidos, dirección de correo electrónico, DNI…) y datos de uso de la plataforma (servicios hoteleros contratados, estancias, reservas de actividades …..)</li><li class="list-disc ml-4">Categorías de interesados: Huéspedes de la propiedad, Personal de la propiedad</li><li class="list-disc ml-4">Operaciones de tratamiento autorizadas: las estrictamente necesarias para alcanzar la finalidad del encargo.</li></ul></li><br><li class="list-decimal ml-4 font-bold text-xl">Obligaciones y derechos del RESPONSABLE<div class="text-base font-normal pt-4">El <strong>responsable</strong> garantiza que los datos facilitados al <strong>encargado</strong> se han obtenido lícitamente y que son adecuados, pertinentes y limitados a los fines del tratamiento.<br><br>El <strong>responsable</strong> pondrá a disposición del <strong>encargado</strong> cuanta información sea necesaria para ejecutar las prestaciones objeto del encargo.<br><br>El <strong>responsable</strong> advierte al <strong>encargado</strong> de que, si determina por su cuenta los fines y los medios del tratamiento, se considerará responsable del tratamiento y estará sujeto a cumplir las disposiciones de la normativa vigente aplicables como tal.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Obligaciones y derechos del <strong>encargado</strong><div class="text-base font-normal pt-4">El <strong>encargado</strong> se obliga a respetar todas las obligaciones que pudieran corresponderle como encargado del tratamiento conforme a lo dispuesto en la normativa vigente y cualquier otra disposición o regulación que le fuera igualmente aplicable.<br><br>El <strong>encargado</strong> no destinará, aplicará o utilizará los datos a los que tenga acceso para un fin distinto al encargo o que suponga el incumplimiento de este contrato.<br><br>El <strong>encargado</strong> pondrá a disposición del <strong>responsable</strong> la información necesaria para demostrar el cumplimiento del contrato, permitiendo las inspecciones y auditorías necesarias para evaluar el tratamiento.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Personal autorizado para realizar el tratamiento<div class="text-base font-normal pt-4">El <strong>encargado</strong> garantiza que el personal autorizado para realizar el tratamiento se ha comprometido de forma expresa y por escrito a respetar la confidencialidad de los datos o que está sujeto a una obligación legal de confidencialidad de naturaleza estatutaria.<br><br>El <strong>encargado</strong> tomará medidas para garantizar que cualquier persona que actúe bajo su autoridad y tenga acceso a datos personales solo pueda tratarlos siguiendo las instrucciones del <strong>responsable</strong> o esté obligada a ello en virtud de la legislación vigente.<br><br>El <strong>encargado</strong> garantiza que el personal autorizado para realizar el tratamiento ha recibido la formación necesaria para asegurar que no se pondrá en riesgo la protección de datos personales.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Medidas de seguridad<div class="text-base font-normal pt-4">El <strong>encargado</strong> manifiesta estar al corriente en lo que concierne a las obligaciones derivadas de la normativa de protección de datos, especialmente en lo que se refiere a la implantación de las medidas de seguridad para las diferentes categorías de datos y de tratamiento establecidas en el artículo 32 del GDPR.<br><br>El <strong>encargado</strong> garantiza que se implementarán adecuadamente dichas medidas de seguridad y ayudará al <strong>responsable</strong> a cumplir las obligaciones establecidas en los artículos del 32 al 36 del GDPR, teniendo en cuenta la naturaleza del tratamiento y la información a disposición del <strong>encargado</strong>.<br><br>El <strong>responsable</strong> realizará un análisis de los posibles riesgos derivados del tratamiento para determinar las medidas de seguridad apropiadas para garantizar la seguridad de la información tratada y los derechos de los interesados y, si determinara que existen riesgos, trasladará al <strong>encargado</strong> un informe con la evaluación de impacto para que proceda a la implementación de medidas adecuadas para evitarlos o mitigarlos.<br><br>El <strong>encargado</strong>, por su parte, deberá analizar los posibles riesgos y otras circunstancias que puedan incidir en la seguridad que le sean atribuibles, debiendo informar, si los hubiere, al <strong>responsable</strong> para evaluar su impacto.<br><br>De todas formas, el <strong>encargado</strong> garantiza que, teniendo en cuenta el estado de la técnica, los costes de aplicación y la naturaleza, el alcance, el contexto y los fines del tratamiento, implementará medidas técnicas y organizativas apropiadas para garantizar un nivel de seguridad adecuado al riesgo que entrañe el tratamiento, que en su caso incluya, entre otros:<br><ul><li class="list-disc ml-4">Accesos son seguros (https)</li><li class="list-disc ml-4">Garantizar la confidencialidad, integridad, disponibilidad y resiliencia permanentes de los sistemas y servicios de tratamiento.</li><li class="list-disc ml-4">Restaurar la disponibilidad y el acceso a datos de forma rápida en caso de incidente físico o técnico.</li><li class="list-disc ml-4">Procedimientos de verificación, evaluación y valoración regulares de la eficacia de las medidas técnicas y organizativas para garantizar la seguridad del tratamiento.</li></div></li><br><li class="list-decimal ml-4 font-bold text-xl">Violación de la seguridad<div class="text-base font-normal pt-4">Las violaciones de seguridad de que tenga conocimiento el <strong>encargado</strong> deberán notificarse, sin dilación indebida y en un máximo de 48 horas, al <strong>responsable</strong> para su conocimiento y aplicación de medidas para remediar y mitigar los efectos ocasionados. No será necesaria la notificación cuando sea improbable que comporte un riesgo para los derechos y las libertades de las personas físicas.<br><br>La notificación de una violación de seguridad deberá contener, como mínimo, la siguiente información:<br><ul><li class="list-disc ml-4">Descripción de la naturaleza de la violación.</li><li class="list-disc ml-4">Categorías y el número aproximado de interesados afectados.</li><li class="list-disc ml-4">Categorías y el número aproximado de registros de datos afectados.</li><li class="list-disc ml-4">Posibles consecuencias.</li><li class="list-disc ml-4">Medidas adoptadas o propuestas para remediar o mitigar los efectos.</li><li class="list-disc ml-4">Datos de contacto donde pueda obtenerse más información (DPO, responsable de seguridad, etc.).</li></div></li><br><li class="list-decimal ml-4 font-bold text-xl">Comunicación de los datos a terceros<div class="text-base font-normal pt-4">El <strong>encargado</strong> no podrá comunicar los datos a terceros destinatarios, salvo que hubiera obtenido una autorización previa y por escrito del <strong>responsable</strong>; la cual, de existir, se anexará al presente contrato.<br><br>La transmisión de datos a autoridades públicas en el ejercicio de sus funciones públicas no son consideradas comunicaciones de datos, por lo que no se precisará la autorización del <strong>responsable</strong> si dichas transmisiones son necesarias para alcanzar la finalidad del encargo.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Transferencias internacionales de datos<div class="text-base font-normal pt-4">El <strong>encargado</strong> no podrá realizar transferencias de datos a terceros países u organizaciones internacionales no establecidos en la UE, salvo que hubiera obtenido una autorización previa y por escrito del <strong>responsable</strong>; la cual, de existir, se anexará al presente contrato.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Subcontratación del tratamiento de datos<div class="text-base font-normal pt-4">El <strong>encargado</strong> no podrá subcontratar a un tercero la realización de ningún tratamiento de datos que le hubiera encomendado el <strong>responsable</strong>, salvo que este lo autorice de manera previa y por escrito, y quede constancia anexando la autorización al presente contrato.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Derechos de los interesados<div class="text-base font-normal pt-4">El <strong>encargado</strong> creará, siempre que sea posible y teniendo cuenta la naturaleza del tratamiento, las condiciones técnicas y organizativas necesarias para asistir al <strong>responsable</strong> en su obligación de responder a las solicitudes de los derechos del interesado.<br><br>Corresponde al Responsable de Tratamiento.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Responsabilidad<div class="text-base font-normal pt-4">Conforme al artículo 82 del GDPR, el <strong>responsable</strong> responderá de los daños y perjuicios causados en cualquier operación de tratamiento en que participe y no cumpla lo dispuesto en el GDPR, y el <strong>encargado</strong> únicamente responderá de los daños y perjuicios causados por el tratamiento cuando no haya cumplido con las obligaciones del GDPR dirigidas específicamente al <strong>encargado</strong> o haya actuado al margen o en contra de las instrucciones legales del <strong>responsable</strong>. Del mismo modo, el <strong>encargado</strong> estará exento de responsabilidad si demuestra que no es en modo alguno responsable del hecho que haya causado los daños y perjuicios.</div></li><br><li class="list-decimal ml-4 font-bold text-xl">Fin de la prestación de servicio<div class="text-base font-normal pt-4">Una vez finalice la prestación de servicios objeto de este contrato, si el <strong>encargado</strong> hubiera almacenado datos personales,  o cualquier otro documento y/o soporte que se le hubiera facilitado por cualquier medio, deberá devolverlas o suprimirlas a elección del <strong>responsable</strong>, incluidas las copias existentes. El <strong>encargado</strong> deberá emitir un certificado de devolución o destrucción si así lo exigiera el <strong>responsable</strong>.<br><br>No procederá la supresión de datos cuando se requiera su conservación por una obligación legal, en cuyo caso el <strong>encargado</strong> procederá a la custodia de los mismos bloqueando los datos y limitando su tratamiento en tanto que pudieran derivarse responsabilidades de su relación con el <strong>responsable</strong>.<br><br>El <strong>encargado</strong> mantendrá el deber de secreto y confidencialidad de los datos incluso después de finalizar la relación objeto de este contrato.<br><br>Entertainment Solutions se reserva el derecho de modificar cualquier tipo de información que pudiera aparecer en el sitio web, así como en las presentes condiciones, sin que exista obligación de preavisar o poner en conocimiento de los usuarios dichas obligaciones, entendiéndose como suficiente la publicación en el sitio web de Entertainment Solutions.</div></li></ul><br><br><br><br>Ultima actualización: 11 de enero de 2021
